Please read and fully understand these Terms of Service (hereinafter referred to as "these Terms") carefully before using Makeroad (including but not limited to makeroad.com, mobile applications, and all subdomains, collectively referred to as "this Website" or "Makeroad"). Your click of "Agree" or your actual utilization of any feature of Makeroad shall constitute your acceptance that you have read, comprehended, and consented to be bound by all provisions of these Terms of Service. Should you disagree, you must cease all use forthwith. This agreement also serves as a legally binding document between Makeroad and the user.
1. Definitions
1.1 "Makeroad" refers to the online community platform for uploading, downloading, and sharing models, operated by MAKEROAD HONG KONG HOLDINGS LIMITED and its affiliates, catering to 3D printing enthusiasts worldwide.
1.2 "User" refers to any natural person or legal entity that registers, logs in, browses, uploads, downloads, or otherwise uses the Makeroad Services.
1.3 "User Content" refers to all digital files, text, images, videos, comments, model source files (including but not limited to STL, 3MF, OBJ, and GCODE) and their derivative works, which a User uploads, publishes, shares, or otherwise submits.
1.4 "Platform Content" refers to all content independently created by Makeroad or legally obtained under license, excluding User Content.
1.5 "User Content" refers to all digital files, text, images, videos, comments, model source files (including but not limited to STL, 3MF, OBJ, and GCODE) and their derivative works, as well as posts, private messages, user-generated works, and all other forms of user-generated content (UGC) that a User uploads, publishes, shares, or otherwise submits.
2. Account Registration and Use
2.1 Eligibility
• You must be at least 14 years old, or have obtained consent from a guardian.
• If the laws applicable in your country provide otherwise, those laws shall prevail.
2.2 Registration Information
• When registering an account, you must ensure that the provided account information, such as your phone number, email address, and username, is true, lawful, and valid. You are also required to update this information promptly in case of any changes. It is strictly prohibited to register an account by impersonating others.
• Makeroad may require additional information for purposes such as identity verification, payment processing, taxation, or prize delivery.
2.3 Account Security
• You are fully responsible for all activities under your account. Please keep your login credentials secure.
• If you discover any unauthorized use, please notify Makeroad immediately.
• The right to use the account belongs exclusively to the registered individual and is strictly prohibited from being transferred, sold, or rented. Any consequences arising from the disclosure, theft, or unauthorized use of account credentials, such as passwords or verification codes, shall be solely borne by you.
• The platform reserves the right to impose temporary restrictions, functional limitations, or permanent bans on accounts exhibiting abnormal login activities, unauthorized usage, or potential security risks.
2.4 Account Deletion
You may apply for account deletion at any time via "User Center - Delete Account". Within 30 days following deletion, you may contact the platform operator via email at official@makeroad.com to revoke the deletion. After 30 days, Makeroad will delete or anonymize your personal information and User Content, which includes but is not limited to uploaded files, images, videos, comments, and posts, except where otherwise required by laws and regulations or where separate authorization has been obtained.
2.5 Account Ownership Restrictions
Each user may lawfully hold and use only one personal account. Without Makeroad's written consent, users are prohibited from registering accounts in bulk, maliciously registering accounts, or using multiple accounts to circumvent platform rules, manipulate metrics, harass others, or engage in unauthorized publishing or other violations.
3 Service Description
3.1 Makeroad provides users with comprehensive services, including 3D model storage, display, uploading, downloading, community interaction, content publishing, commenting, private messaging, and other related services.
3.2 Makeroad provides users with an information storage space and communication platform. The Platform is under no obligation to conduct prior review of content independently published by users, nor does it make any guarantee as to the authenticity, legality, or completeness of such content. However, the Platform will perform its “notice-and-takedown” obligations in accordance with the law and has the right, pursuant to applicable laws and regulations, this Agreement, and the Platform Rules, to take necessary measures against content suspected of violations, including but not limited to review, deletion, blocking, and restriction of dissemination.
4. License Grant for User Content
4.1 Retention of Rights
You retain all ownership and intellectual property rights to the content you publish, unless otherwise agreed in a separate commercial cooperation or licensing agreement with the Platform.
4.2 License Grant to Makeroad
By uploading or publishing User Content, you grant Makeroad a worldwide, royalty-free, non-exclusive, and sublicensable license to:
• reproduce, display, distribute, adapt, translate, create thumbnails, and use for promotional or advertising purposes within Makeroad;
• use in contests, exhibitions, tutorials, social media, and partner promotions;
• carry out other activities necessary for the operation, backup, security, and improvement of the services.
Scope of Sublicensing:
The Platform has the right to sublicense the above rights, as necessary, to:
• Affiliates and subsidiaries, for providing, improving, and promoting the Platform's services;
• Service providers and technical partners (such as cloud storage, CDN, advertising delivery, translation, or data analytics suppliers), solely to achieve the purposes described in these terms;
• Promotion and marketing partners (such as social media platforms, media channels, or marketing agencies), solely for using your content in promoting the Platform and its services.
Unless you explicitly agree otherwise, the Platform will not sublicense your User Content to third parties unrelated to the Platform's services for their independent commercial purposes.
This license remains in effect until the date you delete the specific User Content or delete your account, but shall continue for content that has been incorporated into Platform Content or has been legally downloaded and used by third parties.
4.3 Creative Commons (or Other) Licenses
When uploading, you may choose an open-source/sharing license (e.g., CC BY, CC BY-NC-SA, CC0, etc.). This license is effective for other users. Makeroad acts solely as a distribution platform and is not responsible for the enforcement of these licenses.
4.4 Ownership and Responsibility for User Content
You guarantee that all content you publish, upload, transmit, or share is fully owned by you, including complete copyrights, intellectual property rights, and other necessary rights, or that you have obtained lawful, sufficient, and valid authorization from third parties. If your user content infringes upon rights, violates laws, or breaches third-party rights, resulting in complaints, reports, administrative investigations, lawsuits, arbitrations, claims, or other disputes, you shall bear full responsibility. Should Makeroad incur any losses, expenses, or liabilities as a result, Makeroad reserves the right to seek compensation from you.
5. Usage Restrictions and Prohibited Conduct
5.1 You shall not:
(a) Upload content that infringes upon the intellectual property rights, privacy rights, portrait rights, or other legitimate rights and interests of others;
(b) Publishing illegal, violent, pornographic, discriminatory, weapon-making guides, or other inappropriate content, including but not limited to content involving terrorism, gore, abuse, harassment, personal attacks, hate speech, endangering national security, violating public order and morals, malicious defamation of others, or unauthorized disclosure of others' private information.s, or other inappropriate content;
(c) Reverse engineer, engage in scraping/crawling, bulk download, or build competitive products; including but not limited to:
• Reverse Engineering: Decompile, disassemble, decrypt, reverse engineer source code, or use any technical means to probe the internal structure or implementation principles of the Platform's software, applications, interfaces, or other technical elements;
• Scraping/Crawling: Access, scrape, index, or copy data, content, or services from the Platform in bulk through automated programs, scripts, bots, crawlers, etc., without the Platform's prior explicit written permission;
• Bulk Downloading: Obtain, cache, or store content or data from the Platform in a centralized or large-scale manner, bypassing normal usage scenarios, affecting Platform operation, or exceeding reasonable personal use;
• Building Competitive Products: Use data, content, or technical results obtained directly or indirectly from the Platform to develop, train, promote, or operate products, services, or models that are substantially competitive with this Platform.
(d) Forge identity, manipulate ratings, engage in artificial traffic inflation, money laundering, pyramid schemes, or distribute spam;
(e) Interfere with, disrupt, or attack Makeroad, its servers, or networks in any way;
(f) Maliciously harass, insult, threaten, bully, incite opposition, provoke conflicts, or persistently disturb other users through private messages, comments, posts, user profiles, content interactions, or other means.
(g) Upload, publish, or distribute third-party copyrighted works without authorization, or using the platform to infringe upon others' trademark rights, patent rights, trade secrets, reputation rights, privacy rights, or other legitimate rights and interests.
(h) Engage in other behaviors that violate applicable laws, regulations, or these Terms.
5.2 Violation Handling
The platform adopts a zero-tolerance policy toward violative content, malicious behavior, and actions that severely disrupt community order. Makeroad reserves the right, depending on the severity of the violation and without prior notice, to take enforcement measures including but not limited to: removing violative content, blocking content, restricting content visibility, limiting account functions, issuing warnings, temporarily suspending accounts, permanently banning accounts, retaining records, and providing necessary information to competent authorities or rights holders.
6.Child Safety and Protection of Minors
6.1 Protection of Minors
Makeroad attaches great importance to the protection of minors. If you are under the age of majority in your jurisdiction, you should read and use the Services under the supervision and guidance of your parent or legal guardian. Users shall not use Makeroad in any manner that harms the physical, mental, or lawful interests of minors.
6.2 Prohibited Content and Conduct Involving Minors
You shall not use Makeroad to create, upload, publish, transmit, display, solicit, or otherwise make available any content or engage in any conduct that may endanger the safety, health, or well-being of minors, including but not limited to:
(a) content involving child sexual abuse, sexual exploitation, sexualization of minors, nudity involving minors, or any other sexually suggestive content involving minors;
(b) content involving abuse, violence, bullying, humiliation, harassment, hate, discrimination, coercion, or threats directed at minors;
(c) content that encourages, instructs, glorifies, or promotes self-harm, suicide, dangerous challenges, or other harmful behavior by minors;
(d) any attempt to groom, manipulate, deceive, exploit, or improperly establish contact with a minor;
(e) requesting, collecting, soliciting, or inducing a minor to provide personal information, contact details, location information, images, videos, or to engage in off-platform or off-line contact;
(f) impersonating a minor, parent, guardian, teacher, or any other person or role in order to gain the trust of a minor; or
(g) any other content or conduct that violates applicable child safety laws, regulations, or platform rules.
6.3 Reporting, Review, and Enforcement
Makeroad may, in its sole discretion and to the extent permitted by applicable law, investigate any content, account, or conduct that may involve risks to minors or violate this Section. Makeroad reserves the right to take any action it deems necessary, including but not limited to removing or blocking content, disabling links, restricting features, suspending or terminating accounts, preserving relevant records, and reporting suspected illegal activity to competent authorities or law enforcement agencies.
6.4 User Reporting
If you become aware of any content, account, or behavior on Makeroad that may threaten the safety or lawful interests of a minor, you may report it through the platform's reporting tools or by contacting us at official@makeroad.com. We may request relevant information reasonably necessary to review and process the report.
6.5 Additional Protective Measures
To protect minors, Makeroad may implement age-appropriate safety measures, feature restrictions, visibility limitations, or other protective mechanisms for certain accounts, content, or interactions, as required by applicable law or as reasonably necessary for platform safety and governance.
7 Content Review and Reporting Mechanism
7.1 Makeroad may implement automated keyword filtering and manual review mechanisms, among other content filtering and review measures, to proactively identify, block, restrict, or address content that is suspected of being illegal, infringing, harassing, spam, or in violation of platform rules.
7.2 The platform provides users with a reporting function for violative content. For posts, comments, private messages, user works, model files, and all other UGC content, users may click the "Report" button located at the content entry point, select the type of violation, and submit a report. Types of violations include, but are not limited to: pornography, violence, harassment, abuse, infringement, spam, minors' safety, and other violations.
7.3 The platform has established a content review mechanism and will process reported content within a reasonable timeframe. Content that is clearly illegal, constitutes a serious violation, or endangers user safety may be prioritized for processing. Processing methods include, but are not limited to: removing violative content, warning the violating user, restricting account functions, temporarily suspending accounts, permanently banning accounts, and retaining records of reports and processing actions in accordance with law or platform governance needs.
7.4 In addition to the in-platform report button, users may also submit violation reports via the official email address: official@makeroad.com.
8 User Blocking Mechanism
8.1 To protect user experience, Makeroad provides a user blocking function. You may enter any user's personal profile page and click the "Block" button to perform the operation. After blocking, you will no longer receive notifications of that user's posts, models, works, or comments, nor will you receive private messages or communications from that user, and you may choose to hide that user's relevant public content.
8.2 Makeroad may provide a block list management feature. You can view the list of blocked users in the block management section and, subject to platform functionality, unblock users at any time.
8.3 Blocked users may be unable to actively contact, view, or interact with certain personal content of the blocking party, thereby reducing persistent harassment, unwanted disturbance, or conflict. The specific effects of blocking shall be subject to the actual functionality of the platform.
9 Contests and Rewards
9.1 Participation in a contest implies your agreement to:
• Grant Makeroad the right to use the entry during the contest period and for a reasonable period thereafter for purposes of promotion, judging, awarding prizes, showcasing, and potential future commercial cooperation;
• If you win a prize, agree to the publication of your name / nickname, entry, and necessary personal information for prize distribution and promotion;
• If the specific contest rules stipulate otherwise (e.g., exclusive license, copyright transfer), the contest rules shall prevail.
9.2 Taxes and Fees
Prizes and awards may be subject to taxes or fees levied by third parties, which shall be borne by the winner; Makeroad will provide necessary assistance as required by law.
10 Fees and Payments
10.1 Platform Service Fees
• Access to certain downloads and value-added features may be subject to fees, at the prices as displayed on the relevant pages.
10.2 Maker Earnings
• Your content contributions on the Platform may earn you points rewards according to Platform rules. Points can be used to redeem Products in the points store. High-quality content may receive additional rewards, which will be settled by Makeroad according to the rules published on the Platform;
• For cash settlement of earnings, you must provide true identity information and a valid payment account. Makeroad has the right to withhold applicable taxes.
11. Intellectual Property
11.1 Platform Content, Makeroad trademarks, LOGO, page designs, source code, etc., are owned by Makeroad or its licensors.
11.2 Without the prior written consent of Makeroad, no one may use, copy, modify, or disseminate Platform Content in any form.
11.3 If you believe that User Content infringes your rights, please submit a complaint on the specific model, post, or comment page.
12. Privacy and Data Protection
12.1 Makeroad collects, uses, stores, and shares your personal information in accordance with the Privacy Policy.
12.2 You have the right to access, correct, delete, or export your personal information at any time, and may also withdraw consent for specific processing. Specific methods are available in "Privacy Settings".
13. Disclaimer
13.1 Makeroad is provided "as is" without warranties of accuracy, completeness, suitability, or being virus-free.
13.2 Users shall independently judge and assume risks associated with using model files, printing materials, machine parameters, etc. Makeroad shall not be liable for any direct, indirect, incidental, or consequential damages arising from the use or inability to use the services.
13.3 If applicable law does not allow the exclusion of certain liabilities, disclaimers shall apply to the maximum extent permitted by law.
13.4 This platform is independently operated and has no affiliation with Apple Inc. and Google LLC. Apple and Google does not participate in the operation, content management, or user services of Makeroad, nor does it assume any responsibility for Makeroad or the content on the platform.
13.5 Makeroad provides only technical services and content storage space and cannot completely prevent users from posting violative content. You are solely responsible for evaluating all user-generated content on the platform. Any risks arising from the use, download, reference, or dissemination of UGC content shall be borne entirely by you.
13.6 In the event of service interruption, delay, data abnormality, or functional limitation caused by network failure, system maintenance, third-party service anomalies, force majeure, or other reasons beyond Makeroad's reasonable control, Makeroad will make every effort to restore services but shall not bear any additional liability for damages.
14. Limitation of Liability
To the fullest extent permitted by law, Makeroad's total liability to you for all claims arising from your use of the services (whether based in contract, tort, or otherwise) shall not exceed the greater of:
(a) The total fees you actually paid to Makeroad for the services in the 12-month period preceding the event giving rise to the claim; or
(b) 50 US Dollars (or the equivalent in RMB).
15. Third-Party Links and Services
Makeroad may contain links to third-party websites, APIs, or services; third-party content is the responsibility of the respective parties. Makeroad is not responsible for its legality, accuracy, or security.
16. Modification and Termination of Terms
16.1 Makeroad may update these Terms from time to time based on business development, legal/regulatory changes, or security needs, notifying users via pop-ups, in-site messages, or email. Your continued use after the effective date of changes constitutes acceptance of the modifications.
16.2 If you violate these Terms, Makeroad has the right to suspend, restrict, or terminate your account and access to services without prior notice.
16.3 If you materially breach the terms of this Agreement, applicable laws or regulations, or platform rules, Makeroad may unilaterally terminate the services, permanently ban your account, and such account shall not be reinstated.
17. Governing Law and Dispute Resolution
17.1 The formation, validity, interpretation, performance, and dispute resolution of this Agreement shall be governed by the laws of the jurisdiction in which the Makeroad operating entity is registered.
17.2 In the event of any dispute arising out of or in connection with these Terms or the Services, the parties shall first seek to resolve the dispute through friendly consultation. If such consultation fails, either party may bring legal proceedings before a court of competent jurisdiction in the place where Makeroad is located.
17.3 If the User is a resident of the European Union, then, without prejudice to the mandatory provisions of the GDPR, the consumer protection laws of the User's place of residence shall apply, and the User shall also have the right to lodge a complaint with the local consumer dispute resolution body.
18. Miscellaneous Provisions
18.1 These Terms, together with the Privacy Policy, constitute the complete legal agreement between you and Makeroad.
18.2 If any provision of these Terms is deemed invalid or unenforceable, the remaining provisions shall remain in full force and effect.
18.3 Matters not covered herein may be addressed in separate supplementary agreements, which shall have the same legal effect as these Terms.
